Terms of Service

1. The service

Ballyance is a sales logging and management tool for small business owners. It is an internal tool — not a customer-facing storefront. By creating an account or using Ballyance, you agree to these terms.

2. Your account

You are responsible for maintaining the security of your login credentials. Do not share your password with others. Notify us immediately at chris@ballyance.com if you suspect any unauthorised access.

3. Acceptable use

You may use Ballyance only for legitimate business purposes. You must not:

  • Enter data you are not entitled to collect or process
  • Attempt to access another user's data
  • Use the service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or disrupt the platform
  • Share your account credentials with other people

4. Your responsibilities as data controller

When you use Ballyance to store information about your customers ("Customer Data"), you are the data controller for that data under UK GDPR. Ballyance acts as your data processor, processing Customer Data only on your instructions and only to provide you with the service.

As data controller, you:

  • Warrant that you have a lawful basis(such as legitimate interests or consent) to collect and process each customer's personal data before entering it into Ballyance
  • Are responsible for informing your customers that their data is stored and processed using Ballyance and Supabase (EU-hosted) on your behalf
  • Must comply with all applicable data protection law, including UK GDPR, in your use of the service
  • Are solely responsible for responding to any data subject rights requests from your own customers

5. Data processing

Ballyance processes Customer Data solely to provide you with the service described in these terms. We do not use Customer Data for any other purpose, including advertising or analytics.

Our sub-processors are Supabase (database and authentication, EU-hosted) and Vercel (hosting). By accepting these terms you authorise us to engage these sub-processors on your behalf.

6. Indemnity

You agree to indemnify, defend, and hold harmless Ballyance and Chris McAnallen from any claim, loss, damage, penalty, or expense (including reasonable legal fees) arising from:

  • Your failure to comply with your obligations as a data controller
  • Your breach of any applicable data protection law, including UK GDPR
  • Any third-party claim arising from Customer Data you have entered into the platform

7. Account deletion and data removal

You may delete your account at any time in Settings. On deletion, all your data — including all Customer Data — is permanently and irrecoverably deleted. Financial records (orders) may be retained for up to 7 years as required by HMRC record-keeping obligations.

8. Service availability

We aim to keep Ballyance available at all times but do not guarantee uninterrupted service. We may perform maintenance, apply updates, or take the service offline at any time without prior notice.

9. Limitation of liability

Ballyance is provided "as is". To the maximum extent permitted by law, our total liability to you is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential losses.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
